Source of benefit

An incentive may arise under a tax Act, sector legislation, the Exemptions Act, a legislative instrument or a protected agreement. A promotional statement is not the legal source.

Eligible person and income

A benefit granted to one entity, activity, location, asset or class of income should not be extended to another without legal support.

Conditions and duration

Registration, commencement, investment, employment, export, reporting and ring-fencing conditions can control entry and continued entitlement.

Act 1173 pathway

Sections 37 and 38 of Act 1173 create routes for incentives; they do not automatically grant a tax holiday or exemption.
