Employment, PAYE, Pensions and Expatriate Personnel in Ghana
Connect employment contracts, taxable remuneration, payroll withholding, pensions, immigration permission and expatriate approvals into one controlled monthly process.
A Ghana business and tax research resource from MSL Business School, published through TaxLawGH.
Current position
Start with the rules that change the path.
Determine the legal status, activity, transaction and period before following an administrative step. The conclusions below identify the main branching points; the connected TaxLawGH readers and primary sources carry the exact statutory route.
Employment income
Cash and non-cash benefits, allowances, bonuses, reimbursements and termination amounts require classification under the employment-income rules.
PAYE
The employer withholds, files and pays monthly PAYE on or before the fifteenth day of the following month. A nil return may still be required for a registered employer.
Pensions
The mandatory contribution is 18.5% of basic salary: 5.5% employee and 13% employer, allocated 13.5% to the first tier and 5% to the second tier. Contributions are remitted within fourteen days after the contribution month.
Foreign personnel
A corporate role, Act 1173 expatriate position and immigration work or residence permission are different controls. None should be inferred from the others.
Action path
Work through the obligation in sequence.
Complete each step with a record that can be reconciled to the corporate, tax, banking and regulatory files. Where a fact changes, return to the classification step instead of carrying the former answer forward.
- Classify the worker relationship and execute a contract that matches the actual arrangement.
- Map every cash and non-cash component to the payroll tax, pension and reimbursement treatment.
- Register the employer and employees with the relevant tax and pension systems.
- Obtain the necessary investment-authority and immigration permissions before foreign personnel work in Ghana.
- Reconcile payroll, PAYE, pension remittances, annual schedules and employee changes.
Evidence file
Retain the record behind the result.
A registration, return or approval is only one part of the evidence chain. Keep the underlying facts and reconciliation that explain why the selected legal treatment applies.
- Employment or services contract
- Payroll master data
- Benefit and reimbursement policy
- PAYE computation and returns
- Pension registration and remittance
- Expatriate position or quota evidence
- Work and residence permits
- Annual employee schedule
Failure points
Errors that change the legal result.
These are classification and control failures, not cosmetic filing defects. Resolve them before the first return, payment, shipment, employment date or remittance where possible.
Calling every worker a consultant
Legal and factual substance, not the label alone, drives employment and withholding treatment.
Using net salary without gross-up analysis
A tax-borne arrangement can change the taxable amount and employer cost.
Treating a GIPA position as a work permit
Immigration permission remains a separate legal requirement.
TaxLawGH research route
Move from the task to the exact authority.
Use the detailed guide, consolidated legislation reader, practice note, calculator or current-position record relevant to the decision. Apply the law and amendments in force for the transaction period.
Primary sources
Official evidence used for this route.
Official administrative webpages describe the current channel; enacted legislation controls the legal obligation. A portal instruction should not be treated as amending an Act or legislative instrument.

- Ghana Immigration Service permitsOpen official source
Current-law boundary: later legislation, commencement provisions, transitional rules, Gazette instruments, court decisions or a change in the facts can alter the result. Verify the applicable period before acting.
